Terms of Service

These terms govern your use of the Cresca app and the cresca.ai website (the “Service”), operated by Cresca, Inc., a Delaware corporation (“Cresca”, “we”, “us”). By creating an account or using the Service you agree to these terms and to our Privacy Policy.

1. Your account

You must be at least 16 years old to use Cresca. You are responsible for your account credentials and for everything done through your account. Keep your sign-in email current — it is how your identity is anchored and how we reach you.

2. Your content

You own the content you put into Cresca — your cards, profile, notes, recordings, transcripts, forms, and events. You grant us the license needed to operate the Service: to store, process, transmit, and display your content to you and to the people you share it with. We claim no other rights to it.

Sharing is real: when you give someone your card (or they fill in your form, or you message them), they keep their own copy of what you shared, like a paper business card. Deleting your account does not reach into other people’s copies.

3. Other users and shared content

Cresca connects you with other people, and what they do is up to them. You are responsible for what you choose to share and with whom; recipients are responsible for what they do with it. To the maximum extent permitted by law, we are not responsible for the conduct of any user or for how recipients use the information you share with them — inside Cresca or after exporting it.

We have zero tolerance for objectionable content and abusive behavior. If you come across content or a user that violates these terms, report it from within the app — the “⋯” menu on a profile or contact has a Report action — or email support@cresca.ai. You can also block a user from their contact page. We review reports and act on violations — including removing content and suspending or terminating accounts — typically within 24 hours.

5. AI features

AI features (assistant chat, transcription, summaries) generate content automatically and can be wrong. Review AI output before relying on it. AI processing uses third-party model providers as described in the Privacy Policy.

6. Email sent on your behalf

When you use features that send email (meeting invitations, follow-ups, event invitations), you are the sender of that correspondence and must have a legitimate basis to contact the recipient. We may rate-limit or suspend sending that looks like abuse.

7. Early access

Cresca is in active development, and parts of the Service are offered as beta or early-access features. They may change materially, be withdrawn, or occasionally lose data, and are provided without any commitment to keep them available in their current form.

8. Termination and deletion

You can stop using Cresca at any time and delete your account in the app (Settings → Account). Deletion is irreversible; data is permanently erased within 30 days as described in the Privacy Policy. We may suspend or terminate accounts that violate these terms or create risk for the Service or its users.

9. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content (including AI output) will be accurate.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim and USD 50.

11. Indemnification

You will indemnify and hold Cresca harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the Service in violation of these terms, or your violation of any law or of someone else’s rights — including recording-consent and anti-spam laws.

12. Governing law and disputes

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. Disputes arising from these terms or the Service will be brought exclusively in the state or federal courts located in Delaware, and you and Cresca each consent to personal jurisdiction there. To the extent permitted by law, you and Cresca each waive any right to participate in a class action.

13. Changes to the Service or these terms

We may modify or discontinue features as the product evolves. If we materially change these terms we will post the new version here and update the date above; continued use after a change means you accept it.

14. General

These terms and the Privacy Policy are the entire agreement between you and Cresca about the Service. If part of these terms is found unenforceable, the rest remains in effect; if we do not enforce a provision, that is not a waiver. You may not assign your rights under these terms; we may assign ours as part of a merger, acquisition, or sale of assets.
